Prohibited Conduct Policy

To ensure that the library facilities and library grounds are safe and welcoming for all library users, the Nyack Library has established this Prohibited Conduct Policy setting forth what actions are not permitted in the library or on the library grounds.

Prohibited conduct includes:

  1. Committing any actions that are illegal.
  2. Possessing, displaying, or using any weapon, or using or threatening to use any object in a manner that could be considered a weapon.
  3. Engaging in any physically intimidating, assaultive, or verbally abusive behavior, including making threats of violence. The library maintains a zero-tolerance policy for all forms of threats and acts of violence.
  4. Selling, distributing, consuming, or being under the influence of any alcoholic beverage or controlled substance during public library hours.
  5. Entering or remaining on library premises after being instructed by a member of the library staff not to do so and entering or remaining on library premises outside of normal operating hours without authorization.
  6. Engaging in any behavior that a reasonable person would find disruptive, harassing, threatening or disturbing to library patrons or staff.
  7. Leaving children under the age of 10 unattended on library premises.
  8. Remaining in the teen room other than to browse the collection if you are younger than 6th grade or older than 12th grade.
  9. Engaging in any sexual conduct inside the library or on library grounds.
  10. Soliciting, selling, petition signing, surveying, distributing or posting materials without prior authorization of the Library Director or designee.
  11. Using tobacco, cannabis or vaping products.
  12. Eating, except in designated areas, or drinking beverages in open-top containers. Glass bottles and containers are not allowed.
  13. Sleeping at any time.
  14. Talking loudly, using the speaker function on cellphones, using personal electronic equipment at a disruptive volume, or making ongoing noise that is unreasonably disturbing to other library patrons.
  15. Not wearing shoes or a shirt.
  16. Entering the library with odors or strong scents that could disturb the ability of other patrons to use the library.
  17. Rearranging or using library materials, furniture or equipment without the express consent of the library staff, or in a manner inconsistent with its intent and purpose, including placing feet on library furniture.
  18. Leaving personal items unattended on the library premises. Items will be removed if they appear to be abandoned, and the library will not be responsible for removed items.
  19. Blocking access to any part of the library such as by placing large objects on the floor or tables or in aisles.
  20. Bringing any animal other than a service animal into the library.
  21. Accessing staff-only areas of the library without permission.
  22. Taking library materials into the restroom.
  23. Violating the library rules for acceptable use of the Internet and library public computers. A user accepts these rules before accessing the Internet through a library computer. Copies of these rules are posted and available on the library website (www.nyacklibrary.org).

Enforcement of the Prohibited Conduct Policy

Enforcement of this policy is necessary to promote a safe and comfortable environment for Nyack Library patrons and staff.

In general, library staff will educate and remind patrons about these policies before taking action to enforce the policies. If an individual continues to violate these policies, staff will require them to leave the library for the remainder of the day.

If a person engages in conduct that threatens the life or safety of any person, or that is damaging to library property, equipment or facilities, that person will be asked to leave immediately. If necessary, library staff will contact the police for assistance.

Repeated misconduct or even one serious offense may result in a person being barred from the library for a period of time to be determined at the discretion of the Library Director or designee.
