Nyack Library Local History Department Photograph Collection Reproduction Policy
1. Photographs from the collection are not to be taken from the Local History Department
2. Customers who need photographs from the collection may search for appropriate images in our online collection http://hrvh.org/nyacklibrary or the Nyack Images database.
3. The local history staff will make a print-out from our scan.
Individuals and institutions wishing to receive reproduced images from the collection of the Nyack Library must submit a request in writing. Fees may be associated with use of the image(s). Usage is predicated on the following:
1. Requestor must complete and submit an Image Reproduction Request Form (click here to download).
2. The requestor may not make any derivative copies of the image.
3. The image may not be loaned, sold or given to any commercial agency, person or organization.
4. The integrity of the image must be maintained. Use of the image within a context that is misleading or defamatory is not permitted.
5. In granting permission to the requestor, the Nyack Library does not surrender its own right to use the image or grant others permission to use them.
6. The use of the material in publication (in print or electronic form) complies with any donor agreements that may be attached to the materials.
7. The use of the material in publication (in print or electronic form) complies with copyright restrictions.
8. A copy of the published work containing the image must be given to the Nyack Library free of charge.
9. The image should be cited as follows: “Nyack Library Local History Image Collection.”
Fees for Acquiring copies of images: (payment must be received upfront)
Photocopy of images on acid-free paper $1.00 per image
Scanned copies on photo paper $5.00 per image
Scanned copies on disc $5.00 per disc plus 50 cents per image
Email copy of scanned image $1.00 for 1st image, 50 cents per additional image
Additional costs for image use is as follows:
(Emailed scans or photocopies are included with fees below, scans on photo paper are not) :
-$15 per image for use on a personal website or exhibition.
-$25 per image for publication (in print or electronic form) in a book, journal, magazine, film, or commercial website.
-Payment is due prior to release of images.
Copyright Statement: Some requested works which are physically owned by the Nyack Library may be protected by copyright, trademark or related interests not associated with the Nyack Library. The responsibility for determining whether any such intangible rights exist, for obtaining all necessary permissions, and for guarding against the infringement of those rights that may be held elsewhere, remains with the requestor.
